Vertebral and Spinal Cord Injuries
The largest number of spinal cord injuries in Canada occur in automobile accidents. These injuries are generally due to trauma caused by a sudden blow or impact to the spine that fractures or dislocates the vertebrae. Injury to the spinal cord itself, which consists of a bundle of nerves that run from the base of the brain and down the back, can result in loss of sensation and movement, including paralysis of all four limbs, (quadriplegia) or the paralysis of the lower half of the body (parapalegia). People that suffer vertebral or spinal cord injuries can often no longer work and require a massive amount of attendant care. Other health difficulties may include bladder and bowel complications, inability to regulate blood pressure, reduced control of body temperature, chronic pain and increased susceptibility to respiratory disease.
If you or a loved one has suffered vertebral or spinal cord injuries from an accident or as a result of someone else's negligence, you must protect your rights without delay. The Brain Injury Association of Canada estimates that thousands of Canadians incur traumatic brain injuries each year, with the majority being young adults. Most will have a normal life expectancy but will require special care. A majority of bicyclists who die each year, die of brain injuries. Brain injury affects a significant number of people each year and the numbers are reaching epidemic proportions. The social consequences of a brain injury can be devastating. Many people report losing friends and having difficulty cultivating and maintaining new friendships. These difficulties may result from the person experiencing problems with communication. Imagine the frustration of having difficulty remembering ideas and communicating them coherently and logically during a conversation. Loudness of the speech and knowing when it is appropriate to speak are examples of social skills that we all take for granted. In addition, subtle social skills may have been lost. Slip and Fall injuries
Occupier liability cases involve accidents that occur due to negligent maintenance, or reasonably unsafe or dangerous conditions upon property owned or occupied by someone other than the accident victim. Property owners and business establishments have a duty to provide a safe environment for individuals invited onto their premises. Common situations giving rise to occupier liability accidents include uneven floor surfaces, wet floors without warning, poorly marked changes in elevation, slippery surfaces without warning, broken sidewalks, uneven elevators and broken steps. These types of injuies often occur at a residential home, at a shopping mall, on a dance floor, at a race track, in an airport – or any establishment that requires an occupier to provide reasonable safety for its visitors. Haber & Associates have handled hundreds of slip and fall cases in the past 40 years. Many of these cases involve victims who have been severely injured, become paraplegic or even killed as a result of an establishment failing to protect its visitors from known dangers. If you or a loved one have been injured as a result of a dangerous or hazardous condition on a property, the lawyers at Haber & Associates will be pleased to discuss your rights with you without cost or obligation.
Chronic Pain Injuries
Chronic pain brought on by the onset of traumatic injury can change one's life dramatically. Even simple tasks like moving, sitting, standing or sleeping can become very difficult and cause a tremendous amount of pain. These types of injuries, normally require months of therapy and quite often, the body never heals itself to the way it was pre-accident. The International Association for the Study of Pain defines pain as "an unpleasant sensory and emotional experience associated with actual or potential tissue damage, or described in terms of such damage." Pain is subjective in nature and is defined by the person experiencing it, and the medical community's understanding of chronic pain now includes the impact that the mind has in processing and interpreting pain signals. If you suffer from chronic pain that was caused by an accident at least 6 months ago and prevents you from working, you may be entitled to damages. Haber & Associates has lawyers that will be pleased to discuss your rights with you without cost or obligation.
Transport Canada notes that in 2006, there were 2889 deaths caused by car accident. If your spouse, parent or child has unfortunately been caused to die as a result of the negligence of another person or establishment, you may be able to claim damages under the Family Law Act for wrongful death. Also, in personal injury actions, where negligence results in the death of a loved one, the Trustee or representative of the Estate may bring an action on behalf of the deceased’s estate. In situations such as this, damages to compensate the deceased for pain and suffering are often awarded. In awarding these damages, the intention is to compensate the person for physical and mental suffering and for loss of enjoyment of life caused by the Defendant’s act or omission, such as pain and suffering, loss of income by the deceased through their Estate, care costs, or out-of-pocket expenses. The estate of the deceased may be entitled to compensation for the person's pain and suffering and lost wages, and dependents may have claims for economic loss and emotional loss.
