Q: Have you or a family member been seriously injured in an accident?

A: If you or a family member has been seriously injured in a car accident, there are
certain ways to recover compensation in Ontario. Firstly, anyone that is injured in a
car accident is eligible to receive accident benefits under their own insurance policy
- regardless of who was at-fault for the accident. If you are injured, you need to
immediately contact your own insurance company and inform them of the accident.
Applying for and receiving accident benefits will not raise your premiums if you
were not at fault. You can receive benefits such as income replacement (to replace
your wages), caregiver benefits (if you were a caregiver), rehabilitation and medical
benefits (to pay your physiotherapy and other care), attendant care, lost education
expenses, housekeeping benefits, and death and funeral expenses. The amounts you
receive will be extensively greater if you are catastrophically injured.

Secondly, you can sue an at-fault driver in Ontario for compensation. You may
be able to recover compensation for pain and suffering to compensate you for your
disabilities and how they negatively affect your daily life. You can also claim outof-
pocket expenses, as well as your past and future income loss that is normally
assumed by your current income stream. You can also claim future care costs for
the rest of your life to assist you with your daily living, such as future rehabilitation,
medicine, counseling or assistive devices.
