If am I in a union am I covered by the Ontario Employment Standards act?

Yes and No.  Employees that are members and represented by a union cannot file a claim with the Ministry of Labour. 

You are covered instead by a collective agreement, whether or not you are a member of your union.  You must instead pursue a claim for violation by way of grievance procedure in the collective agreement, if you believe that minimum standards have not been filed.
